What is Online Plea?

It's a way to have a traffic prosecutor review your case without having to come to court for a hearing.

What are the benefits of Online Plea?

You could may get your charge reduced to one with no or less, driver's license points.
And you can do it online rather than going to court!

How is it different online than in court?

It is not. There's a traffic prosecutor reviewing your case and making decisions about your case based on the same criteria they would if you went to court in in person. It just takes place online.

How does it work?

You submit a request online for a a plea bargain (reduced charge/points). A traffic prosecutor reviews your request and If you are eligible, the traffic prosecutor makes a recommendation to a New York State District Court Hearing Officer who then makes the final decision. You get a text or email with the result.

Is there a charge for Online Case Review?

No.

Why does the court allow Online Traffic Case Review?

During the current pandemic, the Agency is concerned with the public’s safety and social distancing can be difficult in a court setting. Realizing that everyone makes mistakes. If you have a good driving record, the traffic prosecutor and New York State District Court Hearing Officer may be willing to approve a lesser charge that does not add points or reduces points added to your license.

Why should I care about points on my license?

Having points on your license can raise your insurance rates, subject you to the New York State Department of Motor Vehicle Ddriver Assessment fees, or result in a suspension or revocation of your driver’s license or privilege to drive.

Suspensions and revocations issued by NYS DMV are transferrable to almost all 50 states. If you are suspended or revoked in New York (even if you do not have a NYS Driver’s License), you will almost certainly be suspended or revoked by any state where you are licensed to drive.

What happens if my request is rejected?

You have 10 days to plead guilty ( you can explain) and pay the fine at the time you take the plea offer, continue your plea of not guily and an in-person trial will be set. More information is on your ticket. Once a trial date is set, there will be no further opportunity to conference with the prosecutor for a reduced charge/points and the matter will proceed to trial at the Agency. You are required to appear in-person for the trial.

What if I hire an attorney, will that change the offer?

No. The plea offer will remain the same, you will still have 10 days to accept or reject any offer from the prosecutor and your case will still be set for trial.

How do I know if I'm eligible?

It depends on your record and other criteria set by the traffic prosecutor. Just enter your ticket information and do a search to find the eligibility criteria. If you are, submit a request. Whether your request is approved is entirely up to the traffic prosecutor

What does it mean if I am ineligible?

It could mean your ticket is too old, or that you have too many past offenses, open tickets or due to the serious nature of the charge. You will also not be eligible under other certain situations. Try a search.

If my request is approved, will I still have to pay a fine?

Yes. The fine could change based on the new charge. Either way, you are still responsible for paying it.

How will I know when a decision has been made?

We will send an email or text as well as update the message on your status page when you come back to the website. Full payment is due at the time you take the plea offer.
